GYM Package:

1. I understand that unless I contact the management either verbally or in writing my gym membership will automatically withdrawn and code removed within (3) days of my due date.

GENERAL

1. Access Code. I understand I should never give anyone my door access code. Giving someone my code or allowing someone to gain entrance to the facility can result in a misdemeanor charge of petty theft. 

2. No credit of membership. I understand that I am paying for gym access, not usage and my account will not be credited or will I be exempt from payment because I haven’t been using the facility. 

3.  Cameras. I understand that cameras are in operation at this facility and I will be videotaped.

4. Legal Liabilities. I understand that I cannot hold the Body Shop Gym LLC responsible for personal injuries, loss of items, or theft. I workout at my own risk.

5. Ages. I understand that anyone under the age of 15 MUST have a parent’s signature before obtaining a access code. NO one under 12 is permitted in Gym Area

6. Contract Terms. I have read and agreed with the 30 day contract terms.

NOTICE 

ANY HOLDER OF THIS CONTRACT OR NOTE IS SUBJECT TO ALL CLAIMS AND DEFENSES, WHICH THE DEBTOR COULD ASSERT AGAINST THE SELLER OF GOODS OR SERVICES OBTAINED WITH THE PROCEEDS HEREOF. RECOVERY HEREUNDER BY THE DEBTOR SHALL NOT EXCEED AMOUNTS PAID BY THE DEBTOR HEREUNDER.

MEMBER is to pay immediately the sum of ____________ dollars for one calendar month membership starting on the date of the agreement. This agreement shall expire on written or verbal communication and returning of the gym key. Automatic renewal of the membership contract will occur by member paying the membership fee listed above for the subsequent month. The renewal period will be for one calendar month starting on the day after the expiration date. Renewal of this contract can be completed for eleven consecutive months. THIS CLUB IS NOT PERMITTED, PURSUANT TO THE VIRGINIA HEALTH CLUB ACT, TO ACCEPT ANY INITIATION FEE IN EXCESS OF $125 OR ANY PAYMENT FOR MORE THAN THE PRORATED MONTHLY FEE FOR THE MONTH WHEN THE CONTACT IS INITIALLY EXECUTED PLUS ONE FULL MONTH IN ADVANCE 

MEMBER represents that he/she is in good physical condition and able to use the equipment provided by The Body Shop. MEMBER fully understands and agrees that in use of the equipment provided, there is a possibility of accidental or other physical injury. MEMBER FURTHER AGREES TO ASSUME THE RISK OF SUCH INJURY AND FURTHER AGREES TO INDEMNIFY THE BODY SHOP FROM ANY AND ALL LIABILITY ATTRIBUTABLE TO THE BODY SHOP BY EITHER THE MEMBER OR THIRD PARTY AS A RESULT OF THE USE OF THE MEMBER OF THE FACILITIES AND ANY INSTRUCTIONS AS OFFERED BY THE BODY SHOP.

The Body Shop agrees that it will make available to MEMBER club facilities, subject to normal breakdown and time for repair, and damage to structure, condemnation or act of God. The Body Shop makes no other warranties and no representations expressed or implied, other than these specifically set forth herein, and as to those members sole and exclusive remedy in the event of breach shall be cancellation of this agreement. In no event shall The Body Shop be held liable for consequential damages. Hours of operation are posted on the front door and at the customer service desk. Any changes to this schedule will be posted at least two weeks in advance.

BUYER’S RIGHT TO CANCEL 

If you wish to cancel this contract, you may cancel by making or delivering written notice to this gym. The notice must say that you do not wish to be bound by the contract and must be delivered or mailed before midnight of the third business day after you sign this contact. The notice must be delivered or mailed to: The Body Shop. If canceled within three business days, you will be entitled to a refund of all monies paid. You may also cancel this contract if this gym goes out of business or relocates and fails to provide comparable alternative facilities within five driving miles of the location designated in this contract. You may also cancel if you become physically unable to use a substantial portion of the facility services for 30 or more consecutive days, and your estate may cancel in the event of your death. You must prove you are unable to use a substantial portion of the facility services by a doctors, physicians assistant or nurse practitioner certificate, and the health club may also require that you submit a physical examination within 30 days or the notice of cancellation. If you cancel after the three business days, the health club may retain or collect a portion of the contract price equal to the proportionate value of the services or use of facilities you have already received. Any refund due to you shall be paid within 30 days of the effective date of cancellation.

NOTICE TO BUYER

The buyer should attempt to resolve with the facility any complaint the buyer has with the health club. The Virginia Department of Agriculture and Consumer Services regulates health clubs in the Commonwealth pursuant to the provisions of the Virginia Health Club Act.

MEMBER acknowledges that he/she has read the terms and conditions which are set forth in this document and agrees to comply herewith. This agreement has been executed in multiple copies and MEMBER acknowledges that a fully completed copy hereof was delivered to and received by MEMBER this ___________ day of _________________, 20______.
